Streszczenie

W artykule przestawiono zagadnienie przestrzegania wolności i praw człowieka w domach

pomocy społecznej (DPS-ach). Celem tekstu jest prezentacja stanu obecnego

oraz rozwiązań prawnych, które zapewniłyby mieszkańcom DPS-ów poszanowanie

ich praw. W artykule wykorzystano wyniki badań przeprowadzonych przez autora

w łódzkich domach pomocy społecznej. W regulaminach tych placówek zawarto wiele

regulacji nadmiernie ograniczających autonomię mieszkańców; z reguły nie były one

uzależnione od stanu intelektualnego lub psychicznego konkretnego mieszkańca.

Respect for freedom and human and civil rights in social assistance houses2

Summary

The article presents the question of respect for freedom and human rights in social

assistance houses (SAH). The aim of the paper is to present the current situation and

legal solutions that would ensure residents of SAH respecting for their rights. In the

article results of research conducted by the author in social assistance houses in Łódź

were utilized. The rules of these institutions include a number of regulations overrestricting

the autonomy of the residents; as a rule, they were not dependent on the

intellectual or mental state of the particular resident.
